Who we are

“NoClip Hair,” “we,” “us,” and “our” refer to PELVI HEALTH, LLC, a Florida limited liability company, with its business address at 6806 S Elemeta St, Tampa, FL 33616, United States.

“Services” means the NoClip Hair website, the hair extension products we sell, and any related features, tools, content, order support, customer service, shipping, returns, refunds, or exchanges we provide. Our store is powered by Shopify. Any sale or purchase you make is made directly with PELVI HEALTH, LLC, not with Shopify.

Acceptance of these Terms

By visiting, browsing, using this website, creating an account, or placing an order, you agree to be bound by these Terms of Service, our Privacy Policy, our Shipping Policy, our Return and Refund Policy, and our Billing Terms and Conditions. Together, these form the agreement between you and us.

If you do not agree to these Terms, please do not use the Services or place an order.

Eligibility

You must be at least the age of majority in your state of residence to use the Services or place an order. If you are under the age of majority, you may only use the Services with the supervision of a parent or legal guardian who agrees to these Terms.

You agree that you are using the Services for personal or household purposes, not for unauthorized commercial resale, export, or distribution.

Your account and order information

To place an order, you may need to provide information including your name, email address, phone number, billing address, shipping address, and payment details. You agree that all information you provide is accurate, current, and complete.

You are responsible for maintaining the security of any account credentials you create and for all activity that occurs under your account. You may not transfer, sell, or assign your account to anyone else.

Our products

NoClip Hair sells physical hair extension products. We make every effort to display product photos, shade images, length options, descriptions, and specifications accurately. However, the appearance of a product on your screen may differ slightly from the physical item due to lighting, photography, device settings, screen brightness, natural hair color, and individual styling.

Hair extension results vary by shade, natural hair texture, hair thickness, length selected, placement, and styling. Product photos and before-and-after images are provided to help you understand the product, but individual results may vary.

Product descriptions, specifications, shade names, lengths, styles, pricing, promotions, and availability may change without prior notice. We reserve the right to limit order quantities, refuse service, or discontinue any product at any time.

Orders and acceptance

When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm acceptance by email and your payment has been processed. We may decline or cancel an order for any reason, including suspected fraud, inability to verify shipping information, inventory issues, pricing errors, payment problems, or abuse of promotions.

If we decline or cancel an order after charging your payment method, we will refund the full amount to the original payment method within 7 days.

You may cancel an order at no cost within 24 hours of purchase as long as the order has not shipped. Once an order has shipped, it must be handled through our standard return or exchange process.

Pricing, payment, and taxes

All prices are in U.S. Dollars. The price charged for any order is the price shown at checkout and confirmed in your order confirmation email. Posted prices do not include applicable taxes unless clearly stated. Sales tax, if required, is calculated at checkout based on your shipping address and shown before you complete your purchase.

If a product is listed at an incorrect price due to a system, typographical, or technical error, we reserve the right to cancel the affected order and issue a full refund. We will notify you by email if that happens.

Shipping, delivery, returns, and exchanges

Shipping, delivery timing, carrier delays, lost packages, damaged items, and related matters are governed by our Shipping Policy. Most U.S. orders arrive within 2 to 5 business days after shipment, depending on location, carrier operations, holidays, and other factors outside our control.

Returns, refunds, and exchanges are governed by our Return and Refund Policy. Those policies are incorporated into these Terms by reference and form part of the agreement between you and us.

Intellectual property

All content on the Services, including brand names, logos, text, images, product photos, videos, graphics, designs, page layouts, product names, product descriptions, icons, and the organization and selection of that content, is owned by PELVI HEALTH, LLC, its affiliates, or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view and use the Services for your own personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, publicly display, download, store, sell, or transmit any of our content without our prior written consent.

“NoClip Hair,” the NoClip Hair logo, and related product names are brand assets of PELVI HEALTH, LLC. All other names, logos, and marks on the Services are the property of their respective owners.

Reviews, photos, videos, and user content

If you submit a product review, photo, video, comment, testimonial, suggestion, message, or other content to us, you grant PELVI HEALTH, LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, display, and distribute that content for lawful business purposes, including customer support, product improvement, advertising, and marketing.

You represent that your submitted content is truthful, belongs to you, and does not violate any third-party rights. You may not submit unlawful, misleading, defamatory, infringing, harassing, abusive, obscene, or harmful content.

We may remove, edit, decline, or refuse to publish user content at our discretion. If you received compensation, a discount, a free product, or any other incentive in exchange for a review or testimonial, you must disclose that clearly.

Prohibited uses

You may access and use the Services only for lawful purposes. You may not, directly or indirectly:

• Use the Services for any unlawful, fraudulent, abusive, or malicious purpose
• Violate any U.S. federal, state, local, or international law or regulation
• Infringe our intellectual property rights or the rights of any third party
• Submit false, misleading, deceptive, or inaccurate information
• Harass, abuse, threaten, defame, or harm any person
• Send spam, chain letters, or unauthorized promotional material
• Impersonate any person, business, or entity
• Upload viruses, malware, or other harmful code
• Collect or track other users’ personal information without permission
• Use scrapers, bots, crawlers, or automated tools that interfere with or place unreasonable load on our systems

We may suspend or terminate access to the Services if we determine that these Terms have been violated.

Third-party services and links

The Services may include or link to third-party tools and services, including Shopify, payment processors, shipping carriers, analytics providers, advertising platforms, review platforms, and customer support tools. Your use of third-party services may be governed by those third parties’ own terms and privacy policies.

We are not responsible for the content, policies, practices, errors, outages, or actions of any third-party service or website.

Relationship with Shopify

Our store is hosted by Shopify and uses Shopify commerce infrastructure. Any purchase is made directly between you and PELVI HEALTH, LLC, not Shopify. Shopify is not responsible for the products we sell, our customer service, our shipping, or our return and refund decisions.

To the extent permitted by law, you release Shopify and its affiliates from claims arising from or related to your transactions with PELVI HEALTH, LLC.

Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Errors, inaccuracies, and omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, shade names, product images, pricing, promotions, shipping estimates, availability, or other information. We reserve the right to correct any error, update information, or cancel an order if information turns out to be inaccurate, including after an order has been submitted. If we cancel an order because of an error, we will notify you by email and issue a refund to the original payment method.

Disclaimer of warranties

The Services and products are provided “as is” and “as available,” except as expressly stated in our policies or required by law. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation of the Services.

Some states do not allow certain warranty disclaimers. To the extent your state does not allow such disclaimers, this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, PELVI HEALTH, LLC, its owners, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, or replacement costs, arising from or related to your use of the Services or any product purchased through them.

In any case, our total liability for any claim arising from or related to the Services or any product will not exceed the amount you paid us for the product giving rise to the claim.

Some states do not allow certain limitations of damages. To the extent your state does not allow such limitations, this section may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless PELVI HEALTH, LLC, its owners, employees, contractors, agents, affiliates, licensors, and service providers from any claim, loss, liability, damage, or expense, including reasonable attorneys’ fees, arising from or related to your breach of these Terms, your violation of any law, your violation of any third-party right, or your misuse of the Services.

Dispute resolution

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Informal resolution first. Before filing any formal claim, you agree to contact us at support@nocliphair.com with a written description of the issue and your proposed resolution. We will respond within 30 days.

Binding arbitration. If informal resolution does not resolve the dispute within 60 days, any controversy, claim, or dispute arising out of or related to these Terms, the Services, or any product purchased through them will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be held in Hillsborough County, Florida, or by telephone or video conference at your option.

Class action waiver. You and PELVI HEALTH, LLC each agree that disputes will be resolved on an individual basis only and that neither party may bring or participate in a class, collective, consolidated, or representative action against the other.

Small claims exception. Either party may bring an individual claim in small claims court in Hillsborough County, Florida, instead of arbitration.

Opt out. You may opt out of this arbitration and class action waiver section by sending written notice to support@nocliphair.com within 30 days of your first order, with the subject line “Arbitration Opt-Out” and including your full name, mailing address, and order number.

Governing law and venue

These Terms and any dispute arising from or related to them or the Services are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to the dispute resolution section above, you and PELVI HEALTH, LLC consent to the jurisdiction and venue of the state and federal courts located in Hillsborough County, Florida.

Consumer rights

Nothing in these Terms excludes, limits, or modifies any right you have under applicable U.S. federal or state consumer protection law that cannot be excluded, limited, or modified by agreement.

If any provision of these Terms conflicts with a non-waivable consumer right, the consumer right controls.

Force majeure

We are not liable for any failure or delay in performing our obligations when the failure or delay results from a cause outside our reasonable control, including natural disaster, fire, flood, hurricane, pandemic, government action, labor disturbance, internet outage, utility outage, carrier delay, supply chain disruption, or other events beyond our control.

Electronic communications

By placing an order, creating an account, contacting us, or opting in to marketing, you consent to receive electronic communications from us, including order confirmations, shipping notifications, return and exchange instructions, customer support replies, account messages, and marketing emails where permitted. You agree that electronic communications satisfy any legal requirement that communications be in writing.

Changes to these Terms

We may update these Terms from time to time. The current version will be posted on this page with the “Last updated” date above. If we make material changes, we may notify you by email or by posting a notice on our website.

Your continued use of the Services after updated Terms are posted means you accept the updated Terms.

General

Entire agreement. These Terms, together with the policies referenced in them, are the entire agreement between you and PELVI HEALTH, LLC regarding the Services.

Severability. If any provision of these Terms is found unlawful, void, or unenforceable, the rest of the Terms remain in effect.

Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms at any time as part of our business operations.
